Peter Huber Kältemaschinenbau SE (HUBER) guarantees perfect quality of the products. The products basically comply with the specifications and descriptions according to HUBER's order confirmation. All products can be used in principle to their full functional extent if the respective valid operating instructions, intended use, professional installation and permissible operating conditions are observed. The Purchaser's claims for defects are based on our General Terms and Conditions of Business and Delivery (especially in Sections VIII. - X.), which are attached to these warranty terms and conditions or can be viewed at www.huber-online.com. In addition to this liability for defects, we grant additional guarantees under the following conditions. For the fastest possible processing, please follow the procedures below in the event of service or return shipment.
Product warranty, extended warranty upon registration
The warranty for material damage for all HUBER products is 12 months from the date of delivery, Offenburg factory. The warranty covers the replacement of defective parts and related labor services at the Offenburg plant. All on-site labor services are expressly excluded from the warranty. The purchaser shall bear all further costs incurred in connection with the warranty claim.
If products are to be returned to HUBER by Purchaser for (warranty) repair, the following procedure shall be deemed contractually agreed:
Prior to return, Purchaser shall report any error messages or malfunctions to HUBER by phone +49 781 9603-244 or via email to info@huber-online.com. HUBER shall then immediately inform Purchaser in writing of a repair identification number ("RGA No."). Purchaser shall mark the packaging and repair shipment with this RGA number.
Purchaser shall, at its own risk and expense (transport, etc.), make the HUBER product properly available at HUBER's place of business or at any other place determined by HUBER to serve the purpose of the (warranty) repair.
All third-party products, accessories, additional products, programs, data and storage media that are not part of the HUBER product must be removed before being sent to HUBER. HUBER shall not be liable for items that have not been removed by Purchaser or that have been damaged before they have arrived at HUBER.
All products must be properly prepared for shipment by Purchaser (cleaned, completely emptied, transport locks activated, etc.) and packed in accordance with standard commercial practice. The Purchaser (shipper) undertakes to remove all hazardous, toxic, harmful substances with which the equipment has come into contact, absolutely residue-free, so that acceptance is safe for the recipient (HUBER).
On-site repairs are only possible on condition that all wage, travel and related costs, including expenses and accommodation costs, are borne by the Purchaser. An on-site repair shall be ordered by Purchaser in writing. He undertakes to provide HUBER with access to the object to be repaired at the agreed date. Costs incurred due to delays on site shall be charged to Purchaser.
The warranty claims are initially excluded to the same extent as claims for defects according to our above-mentioned General Terms and Conditions of Business and Delivery (especially according to clauses VIII. (1.10) - X.).
Beyond this exclusion of warranty claims are additionally excluded: The warranty refers exclusively to the intended use of the device. Maintenance and wear parts are also excluded from warranty claims, as are: damage caused by fire, flooding or other natural events, misuse, unsuitable equipment or electrical malfunctions, damage due to improper heat fluids, unsuitable installation, damage occurring during shipment. Further excluded are glass parts, gaskets, color variations, silk screen lettering, logos, covers, accessories, data or power cables, switch covers and switch enclosures, hoses, connectors, terminals, heat transfer fluids. Repairs, outside work and modifications of any kind not authorized in writing by HUBER, use for a purpose other than that for which it was intended, alteration, removal or tampering with the device label or serial number will void this warranty immediately.
Under no circumstances shall HUBER be liable for damages incurred by the purchaser or end customer due to the unavailability of parts or due to loss of production (e.g. due to delayed delivery).
Any claim (for damages etc.) under these warranty conditions must be made in writing to HUBER before the end of the warranty period. Wage compensation for (specialist) work not authorized by HUBER in writing shall in any case be borne by Purchaser. Part(s) replacement does not imply extension of the original warranty period. Purchaser shall pay all costs for parts, labor and shipping for non-warranty repairs. Prior to performing non-warranty work, Purchaser shall issue a written repair order. HUBER shall invoice Purchaser for parts and labor for all non-warranty repairs.
For all disputes between HUBER and Purchaser, the place of jurisdiction shall be D-77656 Offenburg. At the same time, HUBER shall be entitled to bring an action at Purchaser's principal place of business.
The language of the contract shall be German. If the contracting parties use another language in addition, the German wording shall take precedence.
All legal relations between HUBER and Purchaser shall be governed exclusively by the law of the Federal Republic of Germany applicable to the legal relations of domestic parties, excluding the UN Convention on Contracts for the International Sale of Goods.
